1. Agreement
These Terms of Service ("Terms") govern your access to and use of The Sexual Health Clinician website (sexualhealthclinician.com), online course, AI simulated patient lab, and all related services ("Services"), operated by Dr Armin Ariana ("we," "us," "our").
By accessing our website, enrolling in the course, or using any of our Services, you agree to be bound by these Terms, our Privacy Policy, and our Disclaimer. If you do not agree, please do not use our Services.
2. Eligibility
The Sexual Health Clinician course is designed for registered medical practitioners, particularly general practitioners, in Australia. By enrolling, you represent that:
- You are a registered medical practitioner or health professional, or a student in a relevant clinical training program
- You are at least 18 years of age
- You have the authority to enter into these Terms
We reserve the right to verify your professional standing and to refuse or revoke enrolment at our discretion if eligibility requirements are not met.
3. Enrolment and Access
Upon successful payment, you will receive access to the course content through our learning platform (Thinkific). Your access includes:
- 12 video modules and associated lesson content
- The Sexual Health Consult Workbook
- Access to the AI Simulated Patient Lab (subject to availability and fair-use limits)
- Course quizzes
- A Certificate of Completion upon meeting course requirements
Access is granted on a personal, non-transferable basis. You may not share your login credentials with anyone or allow others to access the course through your account.
4. Pricing and Payment
Course pricing is displayed in Australian Dollars (AUD) on our website and checkout page. All prices include GST where applicable.
Payment is processed securely through Stripe. By purchasing, you authorise us to charge the specified amount to your chosen payment method. Pricing may change from time to time, but any changes will not affect enrolments already completed at the previously stated price.
5. Refund Policy
Refund requests received after 30 days will be considered on a case-by-case basis but are not guaranteed. Refunds will be processed to the original payment method within 10 business days of approval.
Nothing in this refund policy limits your rights under the Australian Consumer Law, including your right to a remedy for a major failure in the supply of services.
6. Intellectual Property
All course content, including video recordings, written materials, the 4 Systems Framework, the Sexual Health Consult Workbook, quiz materials, downloadable resources, website content, and branding, is the intellectual property of Dr Armin Ariana and/or The Sexual Health Clinician.
You may not, without prior written consent:
- Copy, reproduce, distribute, or share course content with non-enrolled individuals
- Record, screenshot, or otherwise capture video or audio from course modules
- Use course materials for commercial purposes, including incorporating them into your own training products or programs
- Create derivative works based on the course content
- Upload course content to any third-party platform or file-sharing service
You are granted a limited, personal, non-exclusive, non-transferable licence to access and use the course materials for your own professional development, for the duration of your access.
7. AI Simulated Patient Lab
The AI Simulated Patient Lab is provided as a supplementary educational tool. By using it, you agree that:
- AI-generated simulated patients are not real patients and their responses are not clinical guidance
- You will not input real patient data, identifying information, or protected health information into the simulated patient lab
- Conversation transcripts may be retained and used to generate post-session feedback
- Voice audio is processed in real time and is not stored after the session
- The AI may produce unexpected, inaccurate, or incomplete responses; these are inherent to AI technology and are not defects in the service
- Access to the simulated patient lab is subject to fair-use limits and system availability
We reserve the right to modify, suspend, or discontinue the AI simulated patient lab at any time, with reasonable notice to enrolled participants where practical.
8. Acceptable Use
You agree not to:
- Use the Services for any unlawful or fraudulent purpose
- Attempt to gain unauthorised access to our systems, platforms, or other user accounts
- Interfere with or disrupt the operation of the website, course platform, or AI simulated patient lab
- Harass, abuse, or harm other participants, staff, or service providers
- Misrepresent your qualifications, identity, or professional standing
- Use automated tools, bots, or scripts to access or interact with the Services
We reserve the right to suspend or terminate your access for violation of these Terms, without refund.
9. Limitation of Liability
To the maximum extent permitted by Australian law:
- The Services are provided on an "as is" and "as available" basis
- We do not warrant uninterrupted or error-free access to the course platform, website, or AI simulated patient lab
- We are not liable for any indirect, incidental, consequential, or special damages arising from your use of the Services
- Our total liability for any claim arising from or relating to the Services is limited to the amount you paid for the course
Nothing in these Terms excludes or limits consumer guarantees under the Australian Consumer Law that cannot be excluded or limited by law.
10. Indemnification
You agree to indemnify, defend, and hold harmless Dr Armin Ariana and The Sexual Health Clinician from and against any claims, damages, losses, or expenses (including reasonable legal fees) arising from:
- Your use of the Services
- Your violation of these Terms
- Your clinical decisions or actions taken based on course content
- Your violation of any third party's rights
11. Termination
We may suspend or terminate your access to the Services if you breach these Terms, engage in prohibited conduct, or fail to meet the eligibility requirements. In the event of termination for cause, no refund will be issued.
You may cancel your enrolment within the refund period as described in Section 5. Outside the refund period, you may request account deletion by contacting us, though no refund will apply.
12. Governing Law and Disputes
These Terms are governed by the laws of Queensland, Australia. Any disputes arising from or in connection with these Terms or the Services will be subject to the exclusive jurisdiction of the courts of Queensland.
Before initiating any formal proceedings, both parties agree to attempt to resolve disputes in good faith through direct communication. If resolution is not reached within 30 days, either party may pursue formal remedies.
13. Modifications
We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date. For enrolled participants, we will provide reasonable notice of material changes by email where practical.
Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.
